These terms cover your use of the YachtSee website and the listing tools on it. The brokerage relationship itself is set out in a separate listing agreement that you sign.

Agreeing to these terms

By using this website or creating an account, you agree to these terms. If you do not agree, please do not use the site.

YachtSee is a yacht brokerage operating from British Columbia, Canada. In these terms, “we” and “YachtSee” mean YachtSee, and “you” means the person using the site.

What these terms do not cover

These are website terms. They are not a brokerage agreement, they do not appoint us as your broker, and they do not create any listing, agency or commission arrangement.

Our brokerage services, the commission you pay, and the obligations each of us takes on are set out in the listing agreement you sign separately. If anything in these terms conflicts with that signed agreement, the listing agreement governs. Commission figures shown elsewhere on this site are indicative and do not form an offer.

Who can use the site

You must have reached the age of majority in your province and be able to enter a binding contract. If you list a vessel, you confirm you own it or are authorised by the owner to sell it.

Your account

  • Give accurate information when you register, and keep it current.
  • Keep your password confidential. You are responsible for what happens under your account.
  • One account per person. Tell us promptly if you think someone else has access to yours.
  • Accounts are limited to ten listings. Contact us if you need more.

You can close your account at any time by asking us. Closing it does not end any listing agreement you have already signed.

Your listing content

The vessel details, photographs, documents and descriptions you upload stay yours. By uploading them you give us permission to host them, to display them on this site, and to publish them on the marketplaces and broker networks we advertise through, including YachtWorld, Boats.com and BoatTrader, for as long as your listing is active.

You are responsible for what you upload. You confirm that:

  • The information is accurate and not misleading, including specifications, condition, hours and known defects.
  • You own the photographs or have permission to use them.
  • You have disclosed what the law and the disclosure form require you to disclose.
  • The vessel is free of any lien, charge or claim you have not told us about.

We may edit listings for presentation, and we may decline or remove a listing we believe is inaccurate, misleading, unlawful, or outside what we broker.

Acceptable use

Do not use this site to:

  • Post anything false, misleading, unlawful, or that infringes someone else's rights.
  • Impersonate anyone, or list a vessel you have no authority to sell.
  • Scrape, crawl or bulk-copy listings, or attempt to extract other users' personal information.
  • Probe, interfere with or overload the site or the systems behind it.
  • Upload malware, or attempt to gain access to an account or area that is not yours.

AI-assisted descriptions

If you ask us to draft a listing description, we generate it from the vessel details you entered. It is a starting point, not a statement of fact. Read it, edit it, and make sure it is accurate before you publish. You remain responsible for everything in your listing, however it was drafted.

What we do not promise

We provide the site as it is. We do not warrant that it will be uninterrupted or error-free, that defects will be corrected, or that any listing will result in a sale, an enquiry, or a particular price.

We are not a party to any sale between a seller and a buyer, and we do not guarantee the conduct of anyone who contacts you through a listing. Verify who you are dealing with, and use a survey, a sea trial and proper closing documents. Nothing on this site is legal, tax, marine survey or financial advice.

Other sites

The site links to marketplaces, guides and service providers we do not control. We are not responsible for their content or their privacy practices.

Limitation of liability

To the extent the law allows, YachtSee is not liable for indirect, incidental, special or consequential loss, or for lost profits, lost sales or lost data, arising from your use of this website.

Our total liability arising from your use of the website is limited to the amount you have paid us for website services in the twelve months before the claim, or one hundred Canadian dollars, whichever is greater. Nothing here limits liability that cannot be limited by law, and liability arising under a signed listing agreement is governed by that agreement.

Indemnity

You agree to indemnify YachtSee against claims, losses and reasonable legal costs arising from your listing content, from your breach of these terms, or from your breach of someone else’s rights.

Suspension and termination

We may suspend or close an account that breaches these terms, or remove a listing, and where it is reasonable to do so we will tell you why. Terms that by their nature should survive — content permissions for listings already published, limitation of liability, indemnity and governing law — continue after your account closes.

Changes

We may update these terms as the service changes. The date at the top shows the current version. Continuing to use the site after a change means you accept it. For a material change we will give notice before it takes effect.

Governing law

These terms are governed by the laws of British Columbia and the laws of Canada that apply there. You and YachtSee agree to the exclusive jurisdiction of the courts of British Columbia, without affecting any right you have to bring a claim in the province where you live.
